1. Your Acceptance

A. By using or visiting the Zytu website (including all the content and functionality available through http://zytu.org/), you agree to all of the below terms of service. If you do not agree with any of these conditions, please do not use the Zytu website.

B. You should review this document from time to time for the most current version of these terms of service. Zytu may modify these terms at its sole discretion, and you agree to be bound by the most current verion of these terms.

C. You agree that Zytu Inc. will not be held liable for any of the content and/or its ratings that you may see or hear while using the Zytu website. You agree to use the Zytu website at your own risk.

2. Zytu Website

A. These terms of service apply to all users of the Zytu Website and any of its services or functionality.

B. The Zytu website may contain links to other third party sites. Zytu assumes no resposibility for the contents of any webpages outside of zytu.org. You expressly agree that Zytu has no resposibility or liability for any third party contents that you may find through the Zytu website.

3. Zytu Accounts

A. You alone are responsibile for the activity of your registered account. Please be sure to protect all user and password information. Do not allow any unauthorized use of your account. You are responsible to immediately report any possible breach in the security of your account.

B. You agree that Zytu Inc. is not liable for any losses that you may experience through the use of the Zytu website, and you may be held responsible for any losses caused to Zytu Inc. by the unauthorized use of your account.

4. Use of the Zytu Website

Zytu offers you the right to access and use the Zytu Website as long as you adhere to the following conditions:

A. You agree that you will not distribute any of the contents or functionality of the Zytu Website with prior written authorization from Zytu Inc.

B. You agree that you will not use any of the Zytu website for commercial uses.

C. Prohibited commercial uses do not include:

• using the Zytu Website to upload your own video or photo and/or maintaining your own profile to promote your own business or creative work;
• using the Zytu Website's embeddable player to put a Zytu video on a third party website, so long as the website does not compete with Zytu Inc.;
• anything that Zytu Inc. has authorized in writing.

D. In using the Zytu Website's embeddable player or photos, you must include a prominent link back to the Zytu website, and you may not alter or cover up the embeddable player or photo in anyway.

E. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the Zytu servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Zytu grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. Zytu reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website (e.g. comments, email) for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.

F. Along with your acceptance of these terms of service in your use of the Zytu website, you also agree to comply with all applicable local, state, national and international laws and regulations.

G. Zytu Inc. retains the right to discontinue any part of the Zytu Website without notice.
